Do you think that social service depts. and the judicial system are partially at fault for children dying?

In many child abuse cases, social workers will make 100s of reports of evidence on the abuse, but nothing is ever done. This ultimately leads to the child dying from the abuse. The argument is that if the abusers would have been prosecuted upon evidence of the abuse, the child would be alive. What do you think? All opinions welcome.
